“[T]he compelling circumstances requirement has disappointed a lot of stakeholders, especially beneficiaries of I-140 petitions, who have to wait for years on end for their green card,” Mehta said. “They’re in the pipeline for the green card — they’re actually camera-ready for the green card — but they can’t apply for it because of the priority date.”

Mehta appeared on Fox News, Channel 46 (in New York) on Sunday, August 18, 2002, in a debate with David Rifkin, a former attorney in the Department of Justice, on the special registration system. In the debate, Cyrus criticized the proposed registration system that will get implemented on September 11, 2002. He noted that the system would lead to needless racial profiling of certain visitors and immigrants without making American safer. It would also go beyond fingerprinting, and impose onerous reporting burdens on innocent people. Failure to comply would lead to the deportation of this person. Mr. Rifkin argued that this system has always been part of the law since 1950s and similar systems are in place in European countries.
